Why you may have paid too much for your energy bills

In 2017, energy suppliers introduced terms in variable energy contracts allowing them to change energy prices unilaterally. The District Court and the Amsterdam Court of Appeal ruled that these price adjustment clauses are unfair and insufficiently transparent. As a customer, you must be able to clearly understand when and why tariffs change and what the financial impact will be. As this was often not the case, the price increases of variable energy contracts are invalid and you may be entitled to reclaim overpaid costs.

Ruling of the Amsterdam District Court

The Amsterdam District Court ruled that the price adjustment clause in Vattenfall's general terms and conditions is unfair. As a result, all price changes based on that clause are unlawful. View the ruling here.

The Amsterdam Court of Appeal ruled on Tuesday 25 March 2025 that Vattenfall's price adjustment clause in a variable energy contract is unfair. View the ruling here.

25 April 2025

Vattenfall appeals to the Supreme Court

Vattenfall disagrees with the ruling of the Amsterdam Court of Appeal of 25 March 2025. The energy supplier has therefore lodged an appeal in cassation with the Supreme Court.

The Supreme Court is the highest court for cassation proceeedings in the Netherlands. This means that the Supreme Court does not reassess all facts and circumstances. The Supreme Court only examines whether the Court of Appeal applied the law correctly and whether the procedure followed the applicable rules.

The Consumer Justice Foundation has sent a letter inviting various energy suppliers to discuss settlement options.

Start of the collective action

The Consumer Justice Foundation launched a collective action against ten energy suppliers: Budget Thuis, Eneco, Energiedirect, ENGIE, Essent, Greenchoice, Greenchoice Business, Oxxio, Vandebron, and Vattenfall. Through this procedure, the foundation aims to secure compensation for customers for unlawful price changes.

You are eligible if you or your business have (or previously had), since 1 April 2017, a variable energy contract or standard contract with one of the Dutch energy suppliers listed below, and the tariffs were adjusted during the term of the contract. Both current and former customers may participate. You may also register multiple contracts with different suppliers.

This action applies to contracts with the following energy suppliers: Vattenfall, Eneco, Essent, Energiedirect, Budget Thuis, Greenchoice, Greenchoice Zakelijk, ENGIE, Oxxio and Vandebron.
